EZReferrals Terms of Service

If you wish to become a Member, you must read this Agreement and indicate your acceptance during the Registration process. This Terms of Service Agreement ("Agreement") sets forth the legally binding terms for your use of EZReferrals services.

'EZReferrals', 'We', 'Us' and 'Our' refers to EZReferrals.net, its subsidiaries, domains, and affiliates, and their respective officers, agents, partners and employees. By using the EZReferrals services, you agree to be bound by this Agreement when you become a Member (which means that you have registered with EZReferrals). You are only authorized to use the EZReferrals services if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the EZReferrals website and discontinue use of the EZReferrals services immediately.

This Agreement includes our policy for acceptable use of the EZReferrals services and content posted on the EZReferrals website, your rights, obligations and restrictions regarding your use of the EZReferrals services and our firm Privacy Policy which can be viewed here.

EZReferrals has the right to modify this Agreement from time to time and any modifications shall be effective upon posting by EZReferrals on the EZReferrals website or forum. You agree to be bound to any changes to this Agreement when you use the EZReferrals services after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

Please choose carefully the information you post and the information that you provide to other members on EZReferrals.net. EZReferrals prohibits any of the following items to be posted: telephone numbers, email address, street addresses, last names, and any obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. If the information provided by EZReferrals members contains inaccurate, inappropriate, offensive or sexually explicit material, products or services, EZReferrals assumes no responsibility or liability for this material. If you become aware of any misuse of the EZReferrals services by any person, please contact EZReferrals by clicking on the "Report Abuse" link within the EZReferrals discussion page.

Forbidden Content
EZReferrals is intended to be a "work friendly" environment, throughout the entire site. We allow the advertising and promotions of several types of ads and content as well as offer a large discussion area in our forums allowing members to discuss whatever they like. We do however have some content we do not allow on EZReferrals either in the form of an advertisement or a discussion in the forums. At no point should the following content be posted or shared on EZReferrals, ever.

The following is a partial list of the kind of content that is forbidden to share on or through the EZReferrals services. EZReferrals reserves the right to investigate and take appropriate legal actions against anyone who, in EZReferrals sole discretion, violates this provision, including without limitation, removing the offending communication, advertisement or photo from the EZReferrals services and terminating the membership of such violators. Prohibited content includes, but is not limited to content that, in the sole discretion of EZReferrals:
Racist content or any content promoting racism in anyway, pornographic or adult content of any kind including links to adult sites, nudity in any form, promotion or linking to sites which prompt visitors to download software or automatically installs software with or without the users knowledge, vulgar or obscene content, harsh language or profuse swearing, promotion of or linking to illegal narcotics, violent or threatening content.

Advertiser Guidelines
All advertisers are expected to follow the content guidelines listed above as well as any additional guide-lines set forth for individual advertisement types. For example timed advertisements do not allow sites which break frames or redirect due to the fact these types of links will interfere with the earning system, however these types of links are allowed with other types of advertisements.

It is the members responsibility to read all guidelines and instructions for all methods of advertising. Advertisements found to be violation the our advertisement or content guidelines in any form will be removed with or without notice to the offending member of the removal, also credits will not be refunded when any advertisement is removed due to guideline violations.

Registrations, Memberships & Profiles
Registration and standard membership is completely free to anyone in the world at least 16 years of age or older, members will never be charged for a basic or "standard" account. Members must choose a username during registration, this username cannot exceed 16 characters and can consist both letters and numbers, members should not register with obscene, vulgar, racist or otherwise offensive usernames. Members should enter true and accurate information when registering an account with EZReferrals and members should update any of that information if it changes. If a member is caught using spoof emails or false information, the account will immediately be terminated.Members will receive a forum account upon their registration to EZReferrals which can be accessed using the same information the member registered with.

All members are allowed to post new topics in the discussion forums as well as join in already existing discussions. Members should be respectful towards other members or another words treat others as you would expect them to treat you throughout the site and community. Members whom abuse the priveledge of being able to use the discussion forums, will have their ability to acess the forums removed.

EZReferrals Community Chat
Registered and logged in members will have access to our community chat room which can be accessed from anywhere in the discussion forums and community. Visitors which are not logged in cannot view or access any part of the chat, however logged in members can of course view any information submitted in the chat. Because of this we recommend members do not share any personal information they wish to remain private while using the chat.

Member Feedback
When a member first joins EZReferrals, their account feedback will start out by default at 75% members of course will want to build this percentage up by completing referral offers or referral offer sign-ups, this percentage basically shows the reputation among the community concerning referral offers. When a member sign-ups to a referral offer, both the owner of the offer and the member whom is completing the offer will have the ability to leave feedback for each other. Even if an offer is canceled before it can be completed or the verification days have ended, both members involved will still be able to leave feedback which will affect both of the members overall feedback scores.

Members should always leave feedback after completing a referral offer/sign-up, feedback helps honest members by allowing others to see their good feedback history. Feedback also helps "stamp out" dishonest members by alerting other members of their bad reputation to referral offers. Members can leave feedback "marks" in one of three types; Positive, Neutral and Negative. Positive should be given to exceptional members whom hold to their end of the offer, this will increase the members overall feedback score. Neutral, will not increase or decrease the members overall feedback score and can be used when a member is unsure or displeased about the offer completion, not necessarily good and not necessarily bad either, but not to the degree of a negative feedback mark. Negative feedback marks should be reserved for members attempting to cheat others out of credits or sign-ups by not registering to to members programs when "taking" a sign-up or by canceling members sign-ups after the member has registered to the program.

Once a members feedback score reaches 80%, the amount of credits needed to create a referral offer will decrease or increase depending on which way the member's feedback score is headed (positive feedback/negative feedback), the amount will decrease/increase again if the members account drops/rises to 80%, same with 90% and 100%, if at any point any members feedback drops down to 60% their ability to access the offer system, either creating or signing-up will end due to their abuse.

The EZReferrals staff will not edit member feedback remarks or comments unless some or all of the text contained in the comment is against our guidelines. Meaning members cannot simply request the staff to remove a feedback comment or negative feedback point, however if the member leaving the comments/feedback mark is abusing the system and leaving members negative feedback just to ruin their reputation, EZReferrals will remove the feedback and take swift action against the abusing member.

Inactive Accounts
If a member is inactive for at least 90 days, their account will be disabled and all account credits, affiliate earnings, tokens, referrals and other account advantages will be reset. Members will not be able to access their account until they re-activate their account. Members of course will receive an email notifying them that their account has been disabled. Members will have 7 days from the day which their account was disabled to re-activated the account or the account will be terminated permanently.

Members on the other hand whom have registered an account, but never logged into their EZReferrals account will automatically be disabled and deleted from the database. Members have at least 10 days to login at least once after their registration, if they never login the account is considered spam or a bot registration.

Zero Tolerance Spam Policy
We have a zero tolerance for spammers whether they're on our site or outside of our site using our advertisements. If any member is caught or reported for spamming their referral links on any forums, websites, blogs or spamming their EZReferrals referral links or any other advertisement links offered by EZReferrals.net in ANY FORM; the incident will be investigated and the offending member, if guilty will forfeit all account credits, tokens, referrals, affiliate earnings and wallet funds on the first offense of spamming. Members whom are caught spamming again after this will have their account disabled.

Our spam policy as mentioned above also goes for our site and forums, we provide more than enough features for members to build their down-lines absolutely free. Therefor any members caught spamming on our sites by ways of posting referral links in posts or trying to recruit referrals using any other than those provided here.

Purchases & Refunds
Members can make purchases such as account credits, membership upgrades and other items using the funds present in their "Affiliate Earnings" which can be viewed from "My Account". Once a member spends his/her affiliate earnings on account upgrades or other purchases, these funds are no longer available for cash-out, nor can this amount be refunded. Additionally members can also perform these purchases using online payment processors. Currently the only payment processor we allow purchases with is PayPal, however this is subject to change in the future.

Purchases by payment processors are not made on "our site", instead members are redirected to the payment processors site for secure entry of credit card numbers or other sensitive information allowing members the most secure checkout. Purchases made by payment processors can only be refunded if the refund request is made before the order is credited to the account.

All purchases made by affiliate earnings are processed immediately, all purchases made by payment processor have a short verification period. The order verification period is intended to protect even further against scams and online identity theft, and should not last more than to 12-24 hours. For the fastest verification processing time, please make sure your account holder information and email accounts match that of your payment processor account holder information.

Charge-backs & Claims
Our refund policy is stated clearly above, members agree to this Terms of Service by registering an account here and using our facilities. Members are even required an extra time to agree to our Terms before making any purchase. Because our refund policy is stiff some members may try to abuse the system by issuing charge-backs or claims/disputes in an effort to double their money, if any member issues a charge-back by payment processor or credit card or opens a dispute/claim by payment processor on any purchase, the members account will immediately be frozen. The process of forfeiture of referrals, affiliate earnings, all account credits and any earnings associated with the members account will take place and the members associated IP addresses will be banned from the network permanently.

Refunds will only be made to members if the refund request is submitted before the purchase has been credited to the account, no exceptions.

Development Periods & Updates
Members will periodically experience developement or update "periods", the amount of time these periods will last are usually announced by way of the forum announcements, announcements in the site header and newsletters. Some of these maintenance periods can take just a few minutes others can take a few days or maybe even longer, the time it takes to complete the processor naturally depends on the amount of work involved and how long it will take the staff to complete the task or tasks.

Unfortunately we cannot avoid these maintenance periods because like any other software, the EZReferrals site and databases must be constantly updated to add new features for our members to enjoy, as well as adding new security patches to ensure our community and members information is as safe as possible.

During these periods members may find that some areas are not accessible or do not work, this is most likely due to the fact the maintenance is taking place in that area of the site, just navigate away from the area and check back later, everything should be back to normal, alternatively members can follow progress of maintenance in the discussion forums and regular updates are posted.

Most commonly if there are any updates or changes being made to any part of the purchasing system, all purchases will be disabled to ensure there are no mistakes or mishaps in terms of members funds. Also, regardless of site maintenance, member affiliate payment requests will not be delayed in anyway due to site additions nor will support tickets, these important functions of th eiste will remain functioning.

Affiliate Payments
Members must reach a minimum of $15.00 before a cash-out can be requested, once a member has reached this amount, they can request cash-out. Payments are made monthly starting the 15th and ending around the 20th. Members must make their request before the 15th to get paid that month, other wise they will have to wait until the following month to be paid. Each month that passes which a member has not reached the cash-out minimum or has not requested cash-out, their earnings will carry over to the following month. All members whom request a cash-out much have a valid and verified PayPal account.

Due to federal regulations set forth by the Office of Foreign Assets Control (OFAC), an office of the US Treasury, EZReferrals is not allowed to send money to certain countries. Users from all over the world can use and participate in EZReferrals and use our services to build their down-lines, however users from countries included on the OFAC list will not be able to earn money for their contributions. Although these members cannot cash-out their affiliate earnings, they can convert these earnings into cash purchases and upgrades! Click here for a list of countries where OFAC prohibits EZReferrals from sending money.

Entering false country information for the purpose of avoiding the OFAC list is grounds for immediate account termination with a loss of all accumulated earnings. EZReferrals retains the right to refuse payment to any EZReferrals user for any reason. EZReferrals affiliate earnings are NOT tax exempt, each member is expected to report their earnings on their taxes, EZReferrals will not do this for you and should not be expected to do so. It is the responsibility of each member to adhere to and understand the appropriate tax laws for your country. If you have questions on how to report the earnings you have received from EZReferrals, please consult with a tax specialist in your country. Additionally we are not responsible for any fees or percentages taken from or added to paymets and purchases by payment processors such as PayPal.

Cashing-out affiliate earnings does not make a member an employee of EZReferrals and members in no way should represent themselves or be considered employees of EZReferrals. Affiliate earnings are based solely on cash bonuses and a percentage of all referral purchases, there are no lotteries, no gambling and no shady raffle ticket systems. Only 'Affiliate Earnings' are subject to cash-out, funds such as your 'Account Wallet' are not subject to cash-out. Members can move their 'Affiliate Earnings' to their 'Account Wallet' to make purchases.

In the future EZReferrals will most likely offer different methods of cash-out such as Check, AlertPay, LibertyReserve and other popular methods, however we still will only be able to make payments to countries which do not fall in the OFAC list. We deeply apologize to anyone this may cause an inconvenience to but, we must follow the law.

Liablity
Limitation on Liability. IN NO EVENT SHALL EZREFERRALS.NET BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF EZREFERRALS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, EZREFERRALS.NET'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO EZREFERRALS.NET FOR THE EZREFERRALS SERVICES DURING THE TERM OF MEMBERSHIP.

Copyrights & Ownership
All information sent by way of submission such as articles, reviews, guides, tutorials and other authored items to EZReferrals will at that time become the sole property of EZReferrals, this property can and maybe altered from its original state to correct spelling error, punctuation and other sentence structure problems or typos.

Warranty & Contracts
- Warranty. EZReferrals provides the service "as-is," "with all faults" and "as available." EZReferrals does not guarantee the accuracy or timeliness of information available from the service. EZReferrals gives no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws that this contract cannot change. EZReferrals excludes any implied warranties including those of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.

- Contract. All parts of this contract apply to the maximum extent permitted by law. A court may hold that EZReferrals cannot enforce a part of this contract as written. If this happens, then you and EZReferrals will replace that part with terms that most closely match the intent of the part that EZReferrals cannot enforce. The rest of this contract will not change. This is the entire contract between you and EZReferrals regarding your use of the service. It supersedes any prior contract or statements regarding your use of the service. If you have confidentiality obligations related to the service, those obligations remain in force (for example, you may have been a beta tester). The section titles in the contract do not limit the other terms of this contract.
